契約違反とは別に、他人へ損害を与えて民事上の責任を生じさせる行為。法律用語として使われる。
This is an act that harms another person and creates civil legal responsibility outside a contract. It may allow the injured person to seek compensation through a lawsuit.

tort は法律でいう「不法行為」で、犯罪そのものではなく、他人に損害を与えて民事上の賠償責任を生じさせる行為です。正しい直線がねじれて外れた図を思い浮かべ、distort「ゆがめる」や torsion「ねじれ」と同じ「ねじれ」の感覚から、不正な行為へ結び付けると定着します。breach of contract「契約違反」と区別し、negligence may be a tort「過失が不法行為になり得る」、sue someone in tort、tort law、tort liability という法律上の組み合わせで押さえると混同しにくいです。

古フランス語のtort（不正）に由来し、ラテン語のtorquere（ねじる）のtortus（ねじられた）が語源です。正義の「直線」から「ねじれて逸れた」行為が転じ、不法行為を意味します。同語根にtorsion（ねじれ）やdistort（歪める）があります。
The word comes from Old French tort, meaning "wrong," and ultimately from Latin tortus, meaning "twisted." Tortus is connected with torquere, "to twist."
